Service Terms

These terms apply to quotes/estimates, service calls, repairs, installations, maintenance, and emergency visits we perform in Ontario.

Scope of Work & Quotes

  • Your quote/estimate will describe the requested work, equipment/materials, and any known exclusions or assumptions.
  • Prices are typically valid for a limited time (e.g., 30 days) and may change if suppliers adjust costs prior to acceptance.
  • If the agreement includes an estimate, the final charge will not exceed the estimate by more than 10%, unless you approve a revised estimate or request additional/different goods or services (change in scope).

Change Orders & Unforeseen Conditions

If site conditions differ from what was reasonably visible at the quote (e.g., concealed defects, code issues, asbestos, unsafe wiring/venting), we will explain options and costs. Additional work proceeds only after your approval (written/email/text approval is acceptable).

Scheduling, Access & Safety

  • You agree to provide safe access, parking, clear work areas, and an adult on site during service.
  • We may refuse/stop work if conditions are unsafe (gas odours, live electrical hazards, structural issues).
  • Emergency/after-hours calls may include minimum or call-out charges.

Permits, Codes & Licensed Trades

  • Gas work: Gas appliance/line installation, service and pressure testing in Ontario must be performed by properly certified personnel/contractors under the Technical Standards and Safety Authority (TSSA) and applicable fuel regulations.
  • Electrical work: Where electrical work requires a permit/notification, it must be performed by or under an ECRA/ESA-Licensed Electrical Contractor (LEC); homeowners have limited DIY rights but otherwise only an LEC may perform the work.
  • We follow applicable codes/standards and coordinate required inspections; these can affect timelines.

Customer Responsibilities

Please disclose relevant history (prior alterations, gas/electrical issues), keep pets/children away from the work zone, and protect belongings near the work area. Tell us if there are known hazards (e.g., asbestos, mould).

Materials, Equipment & Title

Unless stated otherwise, new equipment is supplied with manufacturer warranties. Title to materials passes to you upon full payment. Removed parts/equipment are disposed of by us unless you ask in writing to retain them.

Payment Terms

  • When due: Unless stated otherwise on your quote/invoice, payment is due on completion of the visit or installation.
  • Deposits: May be required for ordered equipment/special items and are applied to the final invoice.
  • Overdue accounts: May accrue interest (e.g., 2% per month, 24% per annum) as permitted by law, plus reasonable collection costs.
  • Methods: As indicated on your invoice (e.g., card, e-transfer, cheque). Receipts/invoices provided electronically.

Cancellations, Rescheduling & Special-Order Items

Please give reasonable notice to reschedule. Special-order/custom items may be non-refundable once ordered.
Note on door-to-door/at-home agreements: Ontario bans unsolicited door-to-door sales for certain HVAC/water products. BSD does not engage in unsolicited door-to-door sales. Where a consumer invites us to their home for a restricted product/service, the 10-day cooling-off right applies under Ontario rules.

Warranties

  • Workmanship (BSD): We warrant our labour for the period stated on your quote (e.g., 90 days on repairs; installation labour warranty as specified).
  • Manufacturer: Equipment carries the manufacturer’s warranty; registration/terms vary by brand/model.
  • Exclusions: Normal wear/consumables, lack of maintenance, misuse/alterations, damage from external issues (e.g., power quality, floods) are excluded.
  • Remedies: Our obligation is to repair or, at our option, re-perform the warranted portion of work.

Maintenance & Owner Care

Your system’s reliability depends on correct use and maintenance (filter changes, annual service where recommended). We’ll provide basic care guidance after work is completed.

Photos & Job Documentation (Optional)

With your permission, we may take job-site photos (equipment only, not people) for records, permits, or before/after documentation. Marketing use requires your separate consent.

Liability Limit

To the fullest extent permitted by law, BSD’s aggregate liability for claims arising from the specific service will not exceed the amount you paid for that service. We are not liable for indirect, incidental, special or consequential damages (loss of use, profit, data), except where such limitations are not allowed by Ontario consumer law.

Force Majeure

We’re not responsible for delays/failures due to events beyond reasonable control (supply chain issues, strikes, extreme weather, utility/inspection delays).

Privacy & Communications

Your personal information is handled per our Privacy Policy (PIPEDA-aligned). Service-related communications (scheduling, safety, invoices) are transactional; optional marketing emails/SMS are sent only with consent and include unsubscribe options per CASL. (See our Privacy & Cookie Policies.)

Dispute Resolution

Please contact us promptly if something isn’t right—we’ll work to resolve issues in good faith. You also retain all rights available under Ontario consumer law.

Governing Law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable therein. Courts of Ontario have exclusive jurisdiction.

Changes to These Terms

We may update these Service Terms. The latest version will be posted here with a revised Effective date.
